1. About these terms
These terms govern your use of this website. The site is published by Yuma IT Pty. Ltd. (“we”, “us”, “our”), the publisher of Compliance On Demand.
By accessing or using the site you agree to these terms. If you do not agree, do not use the site.
2. Scope
These terms apply to the marketing website only. They do not constitute a licence to use the Compliance On Demand product. Product use is governed by separate licence terms, order forms and supporting agreements entered into between us and the customer.
Where there is any inconsistency between these website terms and a signed customer agreement, the signed agreement prevails for matters within its scope.
3. Acceptable use
You may use this site to learn about Compliance On Demand and to contact us about commercial fit. You must not:
- Interfere with or attempt to compromise the security or integrity of the site
- Use automated tools to scrape or harvest content other than via published metadata, sitemaps or feeds
- Use the site or its content in a way that is unlawful, misleading or that infringes the rights of others
- Misrepresent your identity or affiliation when contacting us
4. Self-hosted product
Compliance On Demand is delivered as a self-hosted, single-tenant product that customers run on infrastructure they control. Nothing on this site implies that we operate a managed SaaS instance of the product.
Each customer is responsible for the deployment, hosting, configuration, security, monitoring, backup and ongoing operation of their own instance, including the security of the credentials, evidence and other data stored within it.
5. Billing and payments
Where billing applies under a separate commercial agreement, payments are processed by an accredited third-party payment provider. Payment instrument details are submitted directly to that provider and are not collected, stored or processed by us.
6. Intellectual property
All content on this site, including text, graphics, logos, product names, screenshots and design elements, is owned by us or our licensors and is protected by Australian and international copyright and trade mark law.
You may view and reasonably reference content on this site for evaluation and internal review. You must not copy, reproduce, modify, distribute or publish content from this site for commercial purposes without our prior written consent.
7. Third-party links and services
The site may reference or link to third-party sites and services, including public regulatory sources, vendor advisories and partner organisations. We do not control those sites and are not responsible for their content, availability or practices. Links are provided for convenience and reference only.
8. Information on the site
We aim to keep information on this site accurate and current. The site describes product capabilities, frameworks and integrations at a point in time. Specific commitments about product behaviour, support and service levels are made only in signed commercial documents.
To the maximum extent permitted by law, the content of this site is provided “as is” and without warranties of any kind, express or implied.
9. Australian Consumer Law
Nothing in these terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.
Where we are entitled to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to the resupply of the relevant services or the payment of the cost of having the services resupplied.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of this site.
11. Governing law
These terms are governed by the laws of the State of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
12. Changes to these terms
We may update these terms from time to time. The version in force is the version published at this URL. Continued use of the site after changes are published constitutes acceptance of the updated terms.
